Bought a house... Does this count as fixtures/fittings?
Hi there!
My hubby and I bought a house, and got the keys on Friday. All seems to be in order, except for one thing. The previous owners took the grates from both fireplaces! This renders them useless until we buy new grates.
The description of house stated: Attractive contemporary fire surround. Granite inset and hearth / Marble fire surround. Cast iron inset and polished granite hearth
Does this mean they can take the grates, or are they fixtures and fittings which should be left?
We are thinking of mentioning it to our solictor, but we don't want to kick up a stink if it's usual to take the grates. Having said that these people took everything that wasn't screwed down, including every single bulb!

Some people get very picky about what they take with them when they sell their house. This is especially true if this was a short sale or foreclosure as people sometimes become bitter about losing their home. They take every little thing they can just to be vindictive. Some will even purposely damage a home so be thankful this wasn't the case.
As far as taking the grates being legal, the answer is yes. There are general rules of what is supposed to be left behind which is "anything that is attached must be left" but some people don't follow this rule and it's not strongly enforced. The only time things are done about it is if the sellers take something that was specifically stated in the paperwork. As in, if you had in your paperwork that you wanted the all appliances to remain and then found the stove was missing, that would warrant action as it was requested in the offer and purchase and sales paperwork.
The truth is some people are just stingy. Even though blinds, curtains and any rods are supposed to be left during a home sale many people take them for whatever reason. I'm a little surprised that they took every single light bulb but if they had the energy efficient ones that last many years, it would make a bit more sense that they wanted to keep them. However, they should have replaced them with cheaper bulbs if that were the case.
If the grates are expensive to replace (which I imagine they're not) then it's worth bringing it up to you solicitor but personally, I would just move on. You have your house and didn't complain of any damage you weren't expecting so just replace the grates and enjoy your new home!
